Dealing with the injury of your child can be scary, especially if it is the result of a car accident. While the way that car accident cases involving children are handled very similarly to the way that cases are handled for adults, there are two very distinct differences to remember:

1. Unless the child was a teenager who caused the accident, the liability is usually very clear when it comes to a child’s injury. It won’t matter if your child was in the car that caused the accident or not – they were an innocent bystander and their injuries should be covered.

2. The statute of limitations, or the amount of time you have to file a claim, is “tolled” or extended until the child reaches 18. That means that the normal two-year statute of limitations for personal injury cases in Texas doesn’t expire until the child’s 20th birthday.

It is important to remember, however, that even though the statute of limitations is longer for a minor, it doesn’t mean that you should wait until they are 18 to seek legal advice. Making sure that you are taking all of the right steps very soon after the accident can help protect the child’s legal rights later on down the road.
