What is a Deposition and what do I say if I need to give one?
Depositions are very similar to testifying in Court, but they are done at the offices of one of the lawyers. The witness is sworn in and everything they say could be used in Court. There are many rules about how Depositions can be scheduled, who is subject to a deposition, the scope of questioning, objections to questioning and time limits. I believe that depositions, when well done, are truly the best discovery tool. You should plan on meeting with your lawyer prior to the deposition to be prepared by the attorney to give the best deposition possible. The general preparation will include advice such as telling the truth, listening carefully, never speculating or guessing, and to not get angry with the questions. Deposition questions can be invasive, and you may feel that they are not relevant to your injury, but the other party does have the right to ask most questions.
